Paying my Mother's medical aid

I pay my Mother's medical aid premiums. These deduct from my savings account via a debit order every month. My Mother is fully dependent on myself financially (no income, no assets, nothing). She is 62 years of age. She is NOT disabled. She receives a SASSA grant. Her Medical aid is in her own name, and she is the main member. The reason she is not on my medical aid, is because my medical aid wanted to add a loading to her premium.

Can I claim this monthly premiums back from SARS?

Yes you can as long as she is financially dependent on you. If SARS asks for verification send them her documents and a covering letter explaining the situation.

Thanks so much. When I phoned SARS to ask them this question, they said NO. I asked why, and they said she has to be a dependant on my medical aid, and that I cannot claim if she has her own medical aid. But this is not what it stated on their website. Therefore my fear is that SARS will not accept my evidence (debit order for my bank account with the medical aid, her medical aid certificate).

On their website is states:
A dependant is:
A spouse (i.e. husband or wife)
A child and the child of a spouse (e.g. son, daughter, step son, step daughter, adopted child)
...
Any other member of a person's family for whom he or she is liable for family care and support (e.g. mother, father, mother-in-law, father-in-law, brother, sister, grandparents, grandchildren.)
Any other person who is recognised as a dependent of that person in terms of the rules of a medical scheme or fund.

Often the call centre operatives do not understand the actual law and what is being asked, unfortunately, submit it and if they disallow it we can object and assist in fighting it for you.
