Nico says: 4 December 2015 at 12:44 I currently live and work in the United Kingdom. Should I fill out the ITR12 as Unemployed? All postal correspondence is posted to my mother's address. Should I give my physical address in the UK and postal address as it is at the moment? |
TaxTim says: 7 December 2015 at 13:28 How long have you lived in the UK? Do you earn income in South Africa? |
Nico says: 7 December 2015 at 13:30 I moved here in June of 2012. I don't earn any income in SA. |
TaxTim says: 7 December 2015 at 17:36 Are you registered as a taxpayer in South Africa and did you previously submit tax returns? |
Nico says: 7 December 2015 at 18:50 Yes, I'm a registered taxpayer and I've submitted tax returns in the past. I worked in SA for 6 years before moving to the UK. |
TaxTim says: 8 December 2015 at 11:37 You can do one of two things when completing your tax return. Either click unemployed in the very first question of the SARS eFiling process or you can enter the amount earned in the UK under the "amounts considered non-taxable" section when it asks for amounts earned under s10(1)(o). Both will allow your tax return to not show taxable income and so you won't have to pay tax in South Africa as you will have been working out of the country for long enough. Yes, you can give your UK address. |
Nico says: 8 December 2015 at 12:12 Thank you. After a long call to SARS yesterday I was told that I don't need to file a tax return/report, because I don't work for a South African company and am taxed in the UK. Does this sound right? |
TaxTim says: 9 December 2015 at 13:47 Yes that does sound right as you are not tax resident in South Africa nor earning any income in South Africa. So strictly speaking you don't need to file a tax return. However, if you are planning to tax return to South Africa at some point, and since it sounds like you have not formally emigrated, it is sometimes better to file a nil tax return anyway to ensure you have an unbroken filing history and avoid questions from SARS later. |
