Help! SARS has just informed that I need to submit a 2008 Tax Return

Good day,

Over the past three weeks, I have been in contact with SARS telephonically regarding a refund due to me for the 2015 Tax Year. I have just been informed that SARS has upgraded their system and I now need to submit a Tax Return for 2008 before they will pay the refund. In 2007, I was employed on a part time basis as a tutor whilst I was in my final year of study at University. After graduating in 2007, I started to work on a full time basis at a company from 1 January 2008. I never knew that I needed to submit a tax return for the 2008 year and never received a tax return or an IRP5. This has also never shown up on the e-filing system and I have completed all my other tax returns and received all refunds owing without any hassles. What are the implications of this? What can I do now? Should I go into my nearest SARS office? Will I be expected to pay major penalties?

Did you earn above the tax threshold in 2008 i.e was tax deducted from your salary?
Did you receive payslips?

I am not too sure what the tax threshold amount was for 2008 and if earned above that amount. I remember receiving two salary slips (Jan and Feb 2008) from when I was permanently employed but I am not too sure if the amount would have been above the threshold.

With regards to the part time employment in 2007, I cannot recall if I received any salary slips. I have managed to obtain the IRP5 today which indicates an amount of approx. R630 'tax withheld'.

Did you receive an IRP5 for the part time employment or the full time employment?
Either way, if you can obtain both IRP5s then you can prepare and complete your Tax Return for 2008 by submitting these details.

You could also check your 2008 Tax Return on SARS filing to see if the details from these IRP5s have already been submitted to SARS and if this is the case, the information will already be included in your 2008 Tax Return.

You will need to prepare and submit the 2008 Tax Return before SARS will pay out the refund.

Thank you for your assistance. I have requested the 2008 return on e-filing. No information appears on the return. I will manually input the IRP5 info and submit the return.
