If out of the country for longer than 183 days, what portion of my income is exempt from tax?
Posted 19 June 2013
I worked for a South African company (for 1 year), and did most of my work in another country, where I meet the 183 day & 60 consecutive day requirement. My question is: I earned a basic salary, plus allowances for being in another country, e.g. food allowance, transport, accommodation, etc. These allowances were paid together with my salary. Based on my total income from the company - what portion of this will be taxed and what will be exempt?
How would I handle tax for freelance work?
Posted 17 June 2013
I've just started at a company doing part time work (22nd May). I get paid on an hourly basis, and the amount hours I work is up to me (very flexible - I am a student). I work about 120 hours a month which returns over R10 000 per month. Since it wont be a fixed amount every month (could be less, could be up to R16K), am I provisional tax payer? The first IRP6 is at the end of August, how would I go about handling this?
Would I be expected to pay 25% of all the income from June 2013- February 2014, on payment #2 IRP6 (February 2014)?...

Posted 17 June 2013
My company has sent me overseas for studies with full pay for a year. I also receive an allowance for all my expenses overseas (accomodation, food, transport ...etc).
My first question: Should I declare all the allowance received while I was overseas? My second question: Can I claim for taxes that my employer has paid from my salary while I was overseas?

Posted 8 May 2013
My wife earns a basic income of R2975 per month. This is not taxed due to the tax bracket.
She however, also gives dance classes 10 months a year in which she earns an additional R8330 per month.
It costs her R1650 in petrol and vehicle maintenance per month to run the classes.
How much tax should she keep out monthly to pay SARS what is owed to him?

Tax exemption clause
Posted 11 April 2013
I understand the section 10(1)(o)(ii) about being outside a country for 183 days, of which 60 days must be consecutive in a 12 month cycle. My question however is: the company I work for is registered in SA and pays me in ZAR. But I travel outside South African borders for more than 183 days and for a 60 day continuous stint also...so, am I still exempt from tax then? Or do I have to pay tax as I get paid in ZAR and the company is registered in South Africa?
Can I claim the distance traveled from home to the office as part of my travel allowance claim?
Posted 5 April 2013
I receive a car allowance. At present I claim my business km's from my office ,do my work and till I come back. A colleague says that SARS allows to claim business km's from my home until I get back home at night.
In other words the portion I drive to work and then back home, I should be allowed to claim for. Is this correct?

Tax return - UK income?
Posted 25 March 2013
I returned to SA following 7+ years in UK. I took up permanent employment in SA during June 2011 and am a residing tax payer on my SA income. Before returning to the SA I ran my own business through a limited company, paid corporation tax and in my personal capacity earned a salary (just below the "personal allowance threshold" which consisted of minimum salary allowance + dividends. Since returning to SA the UK company still received fee income from work I did prior to leaving the UK ...

Income tax calculated and then?
Posted 20 March 2013
Hi TaxTim, I hope you can explain to me in simple terms the following. If one receives a gross salary of R20 000.00 with no contribution or allowance paid monthly, then your Income tax calculator calculates that my take home pay is R16 833.32. The R3017.95 PAYE and UIF of 148.72 is paid by my employer. Do I then have to again pay any tax on the R16 833.32 or is that done?
Depreciation on cars, how does it work?
Posted 12 March 2013
Your depreciation calculator - is it up to date in terms of percentages allowed etc?
Second question - I am a sole prop. I know that I can deduct business expenses (not permanently employed), but I am not sure about the installment that I pay for the vehicle (HP). Can I deduct for tax purposes since I use the car for business.
Last question - if the above deduction is allowed, can I also add depreciation of the vehicle to the 'basket' or is it a matter of either or?

Just want to confirm how to dispute SARS denying the wear and tear allowance on my laptop?
Posted 12 March 2013
SARS denied the wear and tear claim according sec 11 e for the laptop I had to buy myself and use at work 100% of the time, they said its denied according to sec 23m, but I'm sure that was incorrectly interpreted because it says except for..... and then refers to sec 11e?!
So do I contact them and say go study a bit and make sure of your facts or how do I go about this? Dispute and add sec 23 for them?
Can I claim for a car which i "leased" from my previous employer?
Posted 5 March 2013
My previous employer bought a fleet of cars which he then branded. The deal was that we pay for it over 4 years after which the car would be evaluated and we could buy it for half the value. I left the company after 4 years and 4 months and was told that he was not selling the car to me. A monthly deduction appears on my commission slip (earned comm.only as a sales executive) for the car and petrol but this does not appear on the IRP5. I also did not receive a travelling allowance.

Foreign cash inheritance, how does the tax work?
Posted 1 March 2013
My two minor children are South African natural persons, and have thus each been issued with their own ID numbers at birth. If a foreign cash inheritance from their overseas great- grandfather to them (in CHF and Euros) , is converted into ZAR and deposited equally in halves into my two minor children's money market bank accounts, then I believe that this inheritance (and all inheritances) are not deemed taxable. Would this assumption be correct ?
Lastly, would interest income accruin...
