I wish to have a property of my parents transferred to myself and the transaction to be concluded using an interest free loan from my parents. I then wish for them to write the loan off annually with the full amount that is allowed by tax, they are married in COP.Will this be possible?The value of the property is R1,5mil - municipal valuationWill there be any additional taxes on such a transaction?

My employer requires me to maintain a home office/ study as they do not provide me with an office. Unfortunately I live in a two bed roomed apartment and I did not want to convert the spare bedroom into an office. I managed to rent a granny flat from my in-laws and converted this into a fully fledged office. I pay a monthly rental to them for the use of the office.
The majority of my income is from commission (more than 75%).

Hi there!
I am currently full-time employed as an editor, but would like to go freelance next year. I am busy putting a proposal together to encourage my current employer to keep me on retainer for a portion of my current duties, for a portion of my current salary from January 2015, so that I can at least be guaranteed a basic salary for the first year or so of being a freelancer while building up a client base.
As far as tax goes, my understanding was that the burden was on freelancers to submit quarterly or annual tax returns, and that employers using freelancers were not necessarily obligated to deduct tax on their fees...

As a shareholder/director of a PTY, if I received "unpaid salary" that then accumulates in a loan account, would I still be require to pay PAYE, even if no income as such is received?

Do I submit an IRP6 for the sale of a primary property if there is no Cap Gains Tax payable?

On 3rd October 2014, I received proceeds from the sale of my primary residence. By my calculations, no capital tax is payable. I am registered as a provisional taxpayer, but have not had reason to pay any provisional tax for 5 years. Do I need to submit a provisional tax return on the sale by Feb 2015, or can I wait until I need to submit an ITR12 next year?

My wife received a R250K cash gift (or loan) from her mother on the condition that it should be repaid if the mother needs it back - otherwise it is to form part of her inheritance.Is there any tax implication to this besides my wife declaring the interest earned on this amount as taxable income on her returns?

My brother has been working on the ships for a while, and wants to transfer about R1mil to his South African account to buy property in Cape Town.
The money is currently in an account in the Cayman Islands.
Everything I have read indicated allowances and limits taking money out of South Africa. Are there any tax implications bringing money in?

How do we declare the Rent Income from the garden flat - just divide it in half for each person (including the applicable deductible expenses e.g. electricity)?

I'm helping my mom do her tax for her small business. We have deducted all the necessary amounts under the expenses section. My mom owns a house that is standing empty and she has a small inheritance of about R100 000. she is a sole prop. do we have to declare this? they are not part of running the business. this is invested in a money market account. she does declare the interest earned to tax.

An IT3(b) certificate from my bank for a fixed deposit usually saysNet Accrued: XNet Earned: YInterest: X+YSo X+Y should be declared on my tax return under code 4201 if I understand SARS guidelines correctly.If that is the case, since the accrued interest is not yet paid to me, the following year it will be paid out.Then would it not occur in Net Earned the following year and essentially be taxed again? Or does the IT3(b) take that into account?

As a freelancer working from home I realize I can claim certain expenses such as electricity. I have seen several sources indicate that I can claim a percentage based on the size of my home office in relation to my entire home, is that the rule?
My work space is maybe 10% of my home but I can confidently say that at least 30% of my electricity expenses is due to the various electronic equipment running 24/7 in that area. How much can I claim, 10% or 30%?
