SARS delay in refunding?

Hi Tim..I submitted my outstanding returns for 2012 on the 02 Dec and 2013 on the 09th Dec. The first one was selected for verification/audit and I submitted the supporting doc on the 3rd, there was a refund due of r971. The second one reflected a refund due to me of r13k, and was not selected for audit as per the notice that is viewable on efiling. No refund after 90 DAYS

Hi there,
I filed my return in September and was asked to submit supporting documents. I did this and received a completion letter. Then I was told my refund is under review and to wait thirty to sixty days. This period has now passed and the matter was escalated two weeks ago...I was told that I would receive feedback within 5 days. Yet...still no refund or feedback. So frustrating speaking to the call centre consultants...They give conflicting information and no one can tell me why SARS is not paying my refund. It's been 3 months......

SARS - Why is an "original assessment" ITA34, positive amount, taken into consideration in the final SOA, even though a final "after a correction" ITR12 submission calculated to a negative reduced amount?What is the use of requesting and allowing a "request for correction" then in the first place?Shouldn't the final submitted ITR12 negative result (after corrections) be the only assessment that counts and be taken into account in calculations of your final SOA...

The result of my assessment shows that I owe SARS money. They have selected me for an audit / verification. I have submitted the supporting documents manually to a SARS branch. SARS could take 90 days to conduct the verification process. Should I pay SARS now, or wait and see what the result of their audit is, and only pay when they get back to me, i.e. maybe in 3 months time.

What is a penalty assessment? I thought I had submitted all my returns as I had broker doing this for me who I paid every year but now I notice that there is a problem with 2010 through to 2013.
IT34 account balance and due date ?

Hi Tim, on my IT34 ist states:"Thank you for submitting your income tax return for the 2014 year of assessment. Your assessment has been concluded and reflects an amount refundable to you of R -14206.18"and then Due Date 2015-01-012nd Date 2015-01-31. I understand that is most probably a refund from SARS, but then they state they want to do a further assessment. What is the normal turn around time for this? Can I expect my refund before 2015-01-31?

If a client/tax payer dies in one tax year but the claim only occurs in another tax year, what transaction year, year of assessment and period of reconciliation do you apply? Will it be the tax year the client died, or the year the claim took place?
Penalty for late submission to SARS?

I submitted my tax return for the 2014 period right on the deadline date. However my 2012 return was not submitted, I finally managed to get the IRP5 and did the submission. In both returns I have a quite high refunds, I was wondering if SARS will penalise me for late submission? Or will they penalise me for the 2012 return only. Last year I was due a refund and they paid it out without any problems.

What does it mean when you have been referred for audit, even though you have submitted your tax return and supporting documentation? Is it because I have a big medical refund?

My wife did not register as a taxpayer previously because she was told she earns a salary below the taxpayer threshold. She now intends registering as a taxpayer. Can she file returns for the last five years since she has incurred medical expenses on her own medical aid amounting to R50000 which was never recovered from the medical aid. Will she receive a tax refund for her medical expenses for the last five years?
Have car allowance but using car that is not registered in my name?

I get a car allowance and the car I am using is registered in my wife's name. She is paying for the vehicle. Sars is refusing to pay me a refund because the car I am using is not registered in my name. Can they do this or do I have grounds to dispute this.

I submitted my eFiling on the 18th and then submitted my supporting Medical payments on the 20th. I have noted on the system it says the last Status is 27th. A refund is owed to me, should I call the call centre to find out when will I get the monies?

When calculating the tax portion on a lump sum payment isn't the first R500,000 tax free which means the tax calculation should only be done on the remaining portion. With a lump sum of R3,000,000 the taxable portion is R2,500,000. This means the tax will be 36% of the amount exceeding R1,050,000 + R130,500 which is 36% times (R2 500 000 - R1,050,000) plus R130,500 = R 652,500

This year I had a verification done on my tax by SARS and was told that I owe them money due to an incorrect RA amount on my 2008 TAX return . Basically the Rands and cents were done incorrectly. I earn rental income so am completing an ITR12 form. Under local assets & liabilities, the "creditors" section... does one complete 'all payments made to creditors throughout the tax year' OR the balance of what is owed for the full account OR the current monthly installment owed OR the installment owed for the month at end of tax year..?

I have received an ITA34 reduced assessment after visiting a SARS branch and submitting all necessary documents. This document shows a refund payable, but also show that I have been selected for audit process. I have not received an ITSA and would like to know, how long does this audit take and will the ITSA show the FINAL refund amount?

My question is around the treatment of the tax on maternity leave that is clawed back. Our company pays 4 months full pay while an employee is on maternity leave,but there is a clawback should the employee resign within 12 months of returning from maternity leave.
We calculate the clawback on a gross salary plus allowances and any benefit payments, eg: Basic pay, plus travel allowance, plus company paid medical aid, plus company paid provident fund, and deduct the sum of these from any outstanding money due to the employee.
