Posted 21 January 2013
I earn commission only, but do not keep a logbook. Can I claim any deduction for travel from my Commission income. I kept the petrol slips.
On the logbook do you need to give reason if a zero entry is made on a day of no travel?

On my logbook I have several entries as zero where I did not use my vehicle for travel. does one need to give reason for this on the logbook?

How do I proceed with a tax directive? (One associated with my ex employer & from the pension fund)
Posted 16 January 2013
I retired on 30th June 2012 and received a SARS Tax Directive that states that "tax amounting to R0.00 is to be deducted from the gratuity / lump sum payment of R308732.65." What use does one make of this tax directive? Am I correct in assuming that this amount is to be subtracted from Income received (Codes 3697 & 3698). Is it still possible to submit my return via the provisional tax electronic medium; or will I now have to file a return manually at the end of February 2013?The p...

SARS appointed my employer as agent?
Posted 7 January 2013
According to SARS I have penalties of R22 250. I only discovered this recently after becoming more educated about the whole tax thing and investigated my own SARS status etc. Naturally I had to update my details and they now know where I work. 3 weeks ago, my employer received a letter saying something about appointment of agency and that she had to pay R1 500 per month over to SARS, in order to pay the penalties. Around the same time I went to SARS offices to log a dispute re the penalties and...

Expense boundaries and amounts on section 4016
Posted 3 January 2013
Hi Tim
Awesome website!
I earn my income on commission and am often entertaining clients, paying for coffee at meetings and lunches, client gifts etc - all part of the relationship building process.
Because of what I have submitted on section 4016, I have been selected for audit. I have kept all my receipts for client entertainment. Can I just submit these receipts and what are the limits here?
Also I have also claimed for bank charges and client production costs. Is this within the boundaries of 'expenses incurred in the production of income?'...

Freelance earning under R60 000 p/a. What tax do I pay?
Posted 3 January 2013
Hi,
I work on a freelance basis. I have one regular client who deducts tax from my pay (@ 23% of invoiced amount).
Other clients pay me in full.
I earned less that R60 000 in the 2012 tax year as I was abroad for most of the year.
As far as I understand, I should not have to pay any tax as I have earned less that R60 000? But I should be reimbursed for the tax I paid through client?
What tax forms do I need to complete?
Thanks

Posted 3 January 2013
Dear Tim,
Me and my wife have been developping few software packages for years.
Now we have a client that wants to purchase them.
1. Is the sale of the software and/or IPR and/or a patent considered a capital gain?
2. Is it is a capital gane, can we sale those in our private capacity?
3. How if this taxed in case that we receive 200k per person each year for a period of 5 years?
Thank you

How much tax is paid on R5,500 and less and is tax paid on commission?
Posted 25 November 2012
My business partner and I have just opened a spa and are paying our therapists less than R5,500 per month. They then also get 10% commission on all treatments performed. Are they required to pay tax, firstly on their salary and secondly, on their commission? What about gratuities?
Also, we have submitted the registration forms for Income Tax and PAYE - we now have a tax number but are waiting to hear back from SARS about PAYE (when I called the call centre they said that the forms hav...

How do I go about submitting documentation for backdated claims?
Posted 20 November 2012
Two of my stepchildren have brain irregularities, one Dandy Walker syndrome, the other Landau Kleffner Syndrome. I have never claimed for any medical or other expenses ito these two children which are dependants on my medical aid. However when the one with DW Syndrome turned 21 I had to go through the motions of proving his dependance to keep him as adult dependant on my MA. Then I was told to indicate on my tax return that I have a disabled dependant. Question is, what is the procedure to claim...

What does deducting home office expenses imply for capital gains tax?
Posted 20 November 2012
I'm an academic and also do some mathematical consulting, so I work partly in my study at home. Firstly, am I entitled to deduct a fraction of my household expenses, and if so, is it equal to the percentage x of floor space taken up by my study? But then does this affect how much capital gains tax I'll pay on my flat when I sell it? Is it then is x% of my flat not entitled to a capital gains tax threshold?

What about fees paid to the HPCSA? Are they tax deductible?
Posted 6 November 2012
I don't see any fees paid by me as reflected on my return as per TaxTim for the HPCSA and other fees as related to my profession- oral hygiene (cpd point package as required by HPCSA and a dental association), I only work for commission and want to know if I can deduct other expenses such as cellphone and petrol ? It doesn't get asked on your TaxTim and I suppose it needs corresponding codes for your IRP5 return?
