Tax deductibility of vehicle lease payments for independent contractors
Posted 3 June 2016
I am an independent contractor. I do not earn any salary. I currently have a vehicle on which I claim a travel deduction. My vehicle requires replacement. I would like to know if I can claim lease payments as a tax deductible expense should I lease a new car. I have not come across any prohibition on the SARS website. This surely is in the production of income as without a car I would not be able to carry out any work at all.

What allowable deductions does a Pilates instructor qualify for?
Posted 30 May 2016
I am a Pilates instructor and earn a commission from the studios I work at and I do my own invoicing for clients I see outside of the studio. The later I am self employed as I understand it. I only started working in South Africa in Aug 2014. My 2015 tax return was done by an accountant. I understand that being self employed and a commission earner I can deduct expenses directly related to earning an income such as:
- Vehicle expenses
- Phone expenses
- Education and training...

Loan to parents
Posted 30 May 2016
I loaned my parents money to purchase a vehicle in December last year. As my mum was going to be the primary driver, it was registered in her name. It was agreed though that my dad would repay the loan at some point in the future when they dispose of their current property. This was obviously an informal agreement but I am concerned that SARS will see this as a "donation" rather than a loan. Is there anything I can do to prevent this from being viewed as a "donation" and having to pay donation ...

what expenses can i claim if I own a taxi?
Posted 26 May 2016
If I own a second vehicle and use that second vehicle 100% as a Taxi. Would the tax be payable on only the income or payable on income - (minus) expenses?
For example, monthly costs breakdown as follows:
Expenses: Vehicle Repayment Costs - R1500 / Vehicle Insurance: R1100 / Vehicle Tracking Costs: R100 // Total: R 2,700. 00
Income: R 8,000. 00
Income (R 8,000. 00) - Expenses (R 2,700. 00) = R 5,300. 00
My question is. Would I pay tax on the income of R 8000 before deducting expenses...

PAYE vs Provisional tax for a member of a CC
Posted 23 May 2016
I am a member of a CC and have 80% interest in the company. I run the operations of the company and have been paying myself salary. The company never registered for PAYE as I was paying provisional tax and I was the only one earning a salary. Now the company is hiring more people and we have registered for PAYE/UIF. DO I carry on submitting provisional tax instead of PAYE or do I cancel Provisional tax and start paying PAYE. If I don't register for PAYE, what can the company provide me with to p...

Can i setoff my personal rental against the rental income of my only property?
Posted 19 May 2016
I built a home, had to move for work and am currently renting out my primary and only property for R16500 per month. In the area to which I moved for my new job I now rent a flat for R10 000 per month. Is there any differentiation in SARS for this scenario or is it regarded as an income of R 16500, I don't mind paying tax on the difference, but it feels like exploitation if I need to pay tax on the full amount of rent earned, I spend R 10 000 on having a place to stay!

Sequestration and Business Vehicles
Posted 13 May 2016
If I have been declared insolvent, can I still make claims against the business use of a vehicle if not registered in my name? For example, I make use of a vehicle registered in someone else's name, but I still make the payments as I am the driver of the vehicle for business purposes. Also, what if exemption was granted and I kept my vehicle, will I then still be allowed to claim against the use of my vehicle used for business even if I am sequestrated?

How is the car allowance calculated if the car cost the business R165 000 (excluding VAT) when it was bought last year (tax year ending 28 Feb 2015) Purchase price did not included a maintenance plan and the employer expected him to use the car equally for business and private. Monthly value of the use of the car for tax is 3. 5% of VAT inclusive cost of the car.

deductions on salary increase
Posted 29 April 2016
My company would like to offer me an increase. I have the choice of a straight bump-up or I can choose if there are specific benefits I would like that will have a benefit for me (additional money in pocket) and that will be beneficial for them (perhaps less tax they need to pay). I earn a straight salary without any travel allowance or any other benefits that is deducted. Please advise on what would be the best for me and for them?

PAYE on a salary below the tax treshold
Posted 26 April 2016
I am currently working at an NPO and earning R 6000 per month. Currently the organisation is taxing me R300 per month (although this often fluctuates randomly). There are no further deductions, apart from UIF. As far as I am concerned, and according to all research I have done, I am not meant to even be paying tax on this amount. Could you please clarify if this is correct, and if not, who can I approach with regards to this money that seems to be going missing?
Thank you in advance.
Do I have to record all kilometers travelled?

What is an effective logbook method for tax?
Posted 24 April 2016
I would like to know what is the most effective way to log your work travels in order to be able to claim it for tax?
Is it really necessary to write down every destination I go to and who was seen, etc? Or do they need to have an odometer reading every day and night (opening and closing?) Or as some say, can it just be based on the reading from 1st March to 28 Feb?
I have downloaded an app which acts as a log book (feulio), would that be sufficient?
